These Terms of Use (hereinafter referred to as the "Terms") set forth the terms of use of the services (hereinafter referred to as the "Services") provided on this website by Himajin Nishinippon Hobby Room (hereinafter referred to as the "Administrator"). Registered users (hereinafter referred to as the "Users") must use the Services in accordance with these Terms.
Article 1 (Application)
These Terms apply to all relationships between Users and the Administrator regarding the use of the Services.
The Administrator may establish various rules, such as usage rules, in addition to these Terms (hereinafter referred to as "Individual Provisions") regarding the Services. These Individual Provisions, regardless of their name, constitute a part of these Terms.
In the event that the provisions of these Terms conflict with the provisions of the Individual Provisions set forth in the preceding article, the provisions of the Individual Provisions shall take precedence unless otherwise specified in the Individual Provisions.
Article 2 (User Registration)
Registration for this Service is complete when a prospective user agrees to these Terms and Conditions, applies for user registration using the method specified by the Administrator, and the Administrator approves the application.
The Administrator may not approve a user registration application if it determines that the applicant has committed any of the following offenses, and shall not be obligated to disclose the reasons for such denial.
If false information is provided in the user registration application.
If the application is from a person who has previously violated these Terms and Conditions.
If the Administrator otherwise determines that user registration is inappropriate.
Article 3 (Management of User ID and Password)
Users shall properly manage their user IDs and passwords for this Service at their own responsibility.
Under no circumstances may users transfer or lend their user IDs and passwords to third parties, or share them with third parties. If a user logs in using a user ID and password combination that matches the registered information, the Administrator will consider that user ID to be used by the registered user.
The Administrator shall not be liable for any damages arising from the use of a user ID or password by a third party.
Article 5 (Prohibited Activities)
Users are prohibited from engaging in the following activities when using this service.
Acts that violate laws, regulations, or public order and morals.
Acts related to criminal activities.
Acts that infringe copyrights, trademarks, or other intellectual property rights contained in the content of this service.
Acts that destroy or interfere with the functionality of the servers or networks of the administrator, other users, or other third parties.
Acts that commercially use information obtained through this service.
Acts that may interfere with the operation of the administrator's services.
Acts of unauthorized access or attempted unauthorized access.
Acts of collecting or storing personal information about other users.
Acts of using this service for fraudulent purposes.
Acts that cause disadvantage, damage, or discomfort to other users of this service or other third parties.
Acts of impersonating another user.
Advertising, advertising, solicitation, or sales activities on this service that are not authorized by the administrator.
Acts aimed at meeting members of the opposite sex who the user has not met.
Acts that directly or indirectly benefit anti-social forces in connection with the administrator's services.
Other acts that the administrator deems inappropriate.
If the administrator discovers any of these acts, the administrator may take measures such as freezing the account. Furthermore, if the administrator deems the actions to be serious, the account may be frozen or deleted without notice.
Article 6 (Suspension of Service Provision, etc.)
The Administrator may suspend or interrupt provision of all or part of the Service without prior notice to the User if it determines that any of the following events exist:
When performing maintenance, inspection, or updates to the computer system related to the Service.
When providing the Service becomes difficult due to force majeure, such as an earthquake, lightning strike, fire, power outage, or natural disaster.
When a computer or communication line is down due to an accident.
For any other reason, the Administrator determines that providing the Service is difficult.
The Administrator shall not be liable for any disadvantage or damage suffered by the User or third party due to the suspension or interruption of the Service.
Article 7 (Restrictions on Use and Cancellation of Registration)
The Administrator may restrict the User's use of all or part of the Service or cancel the User's registration without prior notice if the User falls under any of the following circumstances.
If a User violates any provision of these Terms of Use
If it is discovered that the registration information contains false information
If a User does not respond to a communication from the Administrator for a certain period of time
If the User has not used the Service for a certain period of time since the last use
If the Administrator otherwise determines that use of the Service is inappropriate
The Administrator shall not be liable for any damages incurred by the User as a result of the Administrator's actions pursuant to this Article.
Article 8 (Withdrawal)
Users may withdraw from the Service by following the withdrawal procedures specified by the Administrator.
Article 9 (Disclaimer of Warranties and Disclaimer)
The Administrator makes no express or implied guarantee that the Service is free from actual or legal defects (including defects related to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc., errors, bugs, infringement of rights, etc.).
The Administrator shall not be liable for any damages incurred by the User arising from the Service, except in cases of willful misconduct or gross negligence on the part of the Administrator. However, this disclaimer does not apply if the contract between the Administrator and the User regarding the Service (including these Terms) constitutes a consumer contract as defined by the Consumer Contract Act.
Notwithstanding the proviso set forth in the preceding paragraph, the Administrator shall not be liable for damages incurred by the User due to default on contract or tort caused by the Administrator's negligence (excluding gross negligence), including damages arising from special circumstances (including cases where the Administrator or the User foresaw or could have foreseen the occurrence of the damage). Furthermore, compensation for damages incurred by the User due to default on contract or tort caused by the Administrator's negligence (excluding gross negligence) shall be limited to the amount of usage fees received from the User in the month in which the damage occurred.
The Administrator shall not be liable for any transactions, communications, or disputes arising between the User and other Users or third parties regarding the Service.
Article 10 (Changes to Service Content, etc.)
The Administrator may change, add, or discontinue the content of the Service with prior notice to the User, and the User hereby consents to this.
Article 11 (Changes to Terms of Use)
The Administrator may change these Terms of Use without obtaining the individual consent of Users in the following cases:
When the change is in the general interest of Users.
When the change does not violate the purpose of the Service Agreement and is reasonable in light of the necessity of the change, the appropriateness of the changed content, and other circumstances related to the change.
When changing these Terms of Use pursuant to the preceding paragraph, the Administrator will notify Users in advance of the change, the content of the changed Terms of Use, and the effective date of the change.
Article 12 (Handling of Personal Information)
The Administrator will exercise due care regarding personal information obtained through the use of the Service and will not provide it to any third party.
Article 13 (Notification or Contact)
Notifications or contact between Users and the Administrator will be made in accordance with the method specified by the Administrator. Unless the User notifies the Administrator of a change in accordance with a method separately specified by the Administrator, the Administrator will consider the currently registered contact information to be valid and will notify or contact the User via that contact, and such notice or contact will be deemed to have reached the User at the time of sending.
Article 14 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer or pledge their status under the Service Agreement or their rights or obligations under these Terms to a third party without the Administrator's prior written consent.
Article 15 (Governing Law and Jurisdiction)
These Terms shall be interpreted in accordance with the laws of Japan.
In the event of a dispute regarding the Service, the court with jurisdiction over the Administrator's head office location shall have exclusive jurisdiction.
